Kurt Zitzer, Partner and Practice Chair for our Commercial Litigation and Professional Liability practices has been quoted in an article published by Law360 Insurance Authority. The article, titled Ga. Tort Reform Promises Relief From Insurance Industry Ills discusses the significant proposed reforms to Georgia’s tort claims system aimed at reducing excessive jury awards and litigation costs. Experts for both policyholders and carriers advised that the extent of the gains is yet to be determined.
In the article, Kurt offers valuable insights into the proposed changes, emphasizing the importance of maintaining the attorney-client relationship without third-party influence. He stated, “As an attorney, I’m highly protective of that decision-making because I have an attorney-client relationship, and I don’t want a third party butting in and telling us that ‘this is how the litigation is going to be handled'”.
Kurt also commented on the broader implications of the reforms, noting that the success of these changes will depend on various factors, including the response of the plaintiffs’ bar and ongoing trends in jury verdicts.
