Bradley Lindeman, a partner in our Minneapolis office, has been selected as a faculty member for the June MSBA’s Labor & Employment Law Section Investigator Training Series. He will present “Disparate Impact: Understanding and Evaluating Theories of Unintentional Discrimination” with his co-presenter, Nicholas May, partner at Fabian May & Anderson.
What analysis applies when claims involve the unintentional results of facially neutral employment decision making processes? In this presentation, the speakers discuss the evaluation of claims based on unintentional discrimination or disparate impact. Focus will be on the history of disparate impact claims, the burden shifting framework used to evaluate these claims, and the damages available. The speakers will discuss some common theories and defenses, and a discussion of key cases discussing disparate impact.
