Often the demands of a business take priority over a careful evaluation of the qualifications that are actually required to complete a job. This can lead employers to use screening criteria that are unrelated to success in the job. If such selection criteria unfairly disqualify significantly more qualified candidates from a legally-protected class, the employer can face liability for unintentional (but still unlawful) discrimination.
