Type of Case: Construction
Practice Area(s): Construction
Lawyer(s): Michael D. Hutchens John E. Radmer
Plaintiffs alleged that an electrician was negligent and breached a warranty, causing a fire to a commercial structure. In particular, Plaintiffs claimed that the electrician left metal contamination in an electrical panel, which later caused a significant arcing event, fire, and loss of a commercial structure. The Plaintiffs claimed damages in excess of $1.3 million, plus interest. The Defendant denied that it left metal in the electrical panel and alleged that its work met the standard of care for electricians and was of a workmanlike and professional manner. Defendant presented a case at trial based on testing done by various experts, arc mapping, and metallurgical evaluations. After a 3-½ day trial, the jury returned a complete defense verdict of no negligence or breach of warranty.
